No Sale, No Fee and Marketing Covered: What It Means

A no-sale-no-fee headline only helps a seller when the written authority explains which fee is waived, what marketing is covered, how long the offer applies and what happens if the owner withdraws.

The short answer

For eligible signed campaigns, William Whyte Property may charge no selling fee if the property does not sell and may cover an approved marketing package upfront. It is a conditional offer, not a promise that every possible cost disappears. The written authority confirms eligibility, the successful-sale fee, approved marketing, term, exclusions, withdrawal and reimbursement circumstances before work begins.

Read the headline in five parts

PartQuestion the authority should answer
Eligible campaignWhich properties, campaign types and authority terms qualify?
No selling fee if unsoldWhich professional fee is waived, and when is a property treated as unsold?
Marketing covered upfrontWhich items are approved, to what limit, and who contracts with each supplier?
Campaign termHow long must the campaign run and what activity is required?
Withdrawal or changeWhat is payable if the owner pauses, withdraws, sells privately or appoints another agent?

The signed authority controls the engagement. Read it before photography, advertising or buyer work begins.

What the offer is designed to do

The offer is designed to reduce the seller's upfront risk and align the selling fee with a completed sale. For a qualifying property, William Whyte Property can fund an approved campaign package upfront and forgo the selling fee if the agreed campaign does not produce a sale.

That does not make every campaign identical. Property type, likely sale price, campaign method, advertising requirements and the agreed authority can affect eligibility and approved spend.

The proposal should therefore be read as a property-specific written offer, not as an unlimited general promise.

Ask for these answers before signing

  • 1.The selling fee including GST if the property sells.
  • 2.Every marketing item covered upfront and its approved limit.
  • 3.Whether supplier invoices are in the agency's or vendor's name.
  • 4.The authority term and expected campaign activity.
  • 5.What is payable after an unsuccessful completed campaign.
  • 6.What changes if the owner withdraws, pauses or sells to an introduced buyer.
  • 7.Any reimbursement, exclusivity or continuing-introduction clause.

Why the wording stays qualified

Australian and Victorian consumer law requires advertising to give an accurate overall impression. A small disclaimer cannot repair a broad headline if the real conditions take away its ordinary meaning.

William Whyte Property therefore states that the offer is conditional and places the detailed terms in the written authority. Sellers should not rely on a social post, advertisement or web headline alone.

No Sale, No Fee and Marketing Covered: What It Means — frequently asked questions

Does William Whyte Property charge no fee if my property does not sell?

For an eligible campaign completed under the agreed written authority, the selling fee may be waived if the property does not sell. The authority states exactly what qualifies.

Does William Whyte Property pay for all marketing?

An approved marketing package may be covered upfront for an eligible campaign. The package, limits, exclusions and any withdrawal or reimbursement conditions are property-specific and written into the authority.

What if I withdraw the property?

Do not assume withdrawal has the same outcome as an unsuccessful completed campaign. The authority must state whether marketing, supplier or other costs become payable if the owner withdraws or changes agent.

Is the offer available in every suburb?

Availability is based on the property and campaign rather than a blanket promise for every suburb. Ask for written confirmation for your address.
